motorcycle accident kills marineA Camp Pendleton Marine has been killed in a motorcycle accident on Interstate 805, according to recent reports.

Investigators say that the Marine crashed his speeding motorcycle into a Honda Accord that was stopped on the shoulder after being struck by a hit-and-run driver. The accident occurred in the northbound lanes near the exit ramp for Balboa Avenue. The motorcyclist died at the scene. Witnesses stated that he was wearing his military uniform at the time of the crash. Police reported that the 34-year-old unidentified Marine was a Sacramento resident. No one else was seriously injured in the crash.

Compensation for Motorcycle Wrongful Death

Though motorcycle riding is an extremely popular mode of transportation in California, it carries its own set of risks and dangers. Statistics from the National Highway Traffic Safety Administration (NHTSA) show that 4,668 people died in motorcycle crashes in 2013.

It is clear that motorcyclists carry greater risk than that of occupants in passenger cars because motorcycle riders do not have the added protection of a steel frame. When involved in a collision, the motorcyclist faces severe injury and even death due to the probability of being ejected from the bike, hitting the pavement when the bike turns over or striking a stationary object or another vehicle. Sadly, many motorcycle accidents are due to careless mistakes. Many vehicle drivers fail to notice a motorcyclist before switching lanes or do not see them when making a turn.

If you have a loved one that was killed in a motorcycle accident, you may have legal grounds to seek compensation for damages. California personal injury law allows the family of a motorcycle driver to claim damages from the driver who caused the accident. However, the law limits which family members may seek compensation. Those who are legally allowed to seek compensation include:

  • Spouse
  • Life partner
  • Child
  • Parent
  • Financial dependent

Under California law, these survivors may be entitled to compensation for a range of damages including:

  • Medical bills for the victim from the time of the accident until death
  • Funeral expenses
  • Loss of financial support
  • Loss of relation and care
  • Pain and suffering damages
