Man mowing lawnAccording to recent reports, a man was hit by a car while using his lawnmower. The victim, Carlos Rodrigues, was lucky enough to survive, but he compared the incident to being “tackled by the entire San Diego Chargers team.”

Police state that while Rodrigues was mowing his lawn, a black Ford Focus, driven by 31-year-old Michael Torres, hit 20 feet of fence and destroyed a concrete pillar before knocking Rodrigues, his mower and his garbage can 15 yards.

According to Rodrigues, “I’m really beat up. I feel like I got hit by the whole Chargers team without wearing any kind of gear.” Though he survived, Rodrigues suffered serious injuries including cracked ribs, a punctured lung, deep lacerations and extensive bruising. He now faces a long road to recovery.

His main focus now is making it from his couch to the kitchen. Rodrigues’ wife Chris stated, “You just ruined a family for what you did. You hurt us to the core. For me, I regret, have sorrow, sadness, anger and a lot of anger.” Rodrigues remains positive, saying, “I owe it all to God. I believe he was looking out for me…I just feel very fortunate and I am not going to take another day for granted.”

The driver has been charged with two counts of DUI and was booked into the San Diego County jail.

Personal Injury Claims on Private Property

The case above poses some interesting questions about personal injury law. If you are on your own property and injured, can you claim personal injury? In some cases, it is likely that you can. If someone acts negligently, such as driving while drinking, and injures you by hitting you on your own property, they may be just as responsible as if they had hit you in a parking lot or on the street.

The location of the accident does not matter. What matters is the negligent actions of the driver. When someone acts negligently, the law can hold them responsible for their actions by requiring them to pay compensation to the victims. This compensation is intended to cover medical expenses and lost income as well as provide the victim compensation for pain and suffering.
